Insurance Law

Accidents are a reality of everyday life and may become a nightmare. Dealing with the consequences thereof should not be.

I am of the opinion that insurance is in reality a form of social security in a democratic dispensation, there for the benefit of both the insured and the third party. To avoid abuse, it is crucial that the merits of each and every claim be investigated thoroughly. Herman Prinsloo Attorneys make use of a competent panel of assessors to assist us with the investigation of both the merits and quantum of claims.

Third Party Claims against the Road Accident Fund and claims for Medical Negligence is nothing more than insurance claims by a third party against the insurer of an insured party.

Herman Prinsloo Attorneys accepts instructions to institute claims for:

  • Damages Claims against the driver that caused an accident
(for damages to your motor vehicle)
  • Third Party Claims against the Road Accident Fund
(for medical expenses, loss of income & pain and suffering)
  • Loss of Support Claims against the Road Accident Fund
(after the death in a collision of a person who maintained you)
  • Medical Negligence Claims against the Professional Indemnity Insurer (for negligence by a medical practitioner during medical services).

Construction Law

I have a passion for Construction Law and have represented clients on both sides of the fence (either the Principal or the Contractor) in contractual disputes that arose between them.

Construction related contracts mostly provide for alternative dispute resolution and, for that reason, I completed various Arbitration courses as part of my specialization in this field of the law.

Some of my Contractor-clients regularly submit tenders to organs of state, which necessitates an understanding of Public Administration Law and the review of decisions of organs of state.

I regularly attend seminars on the four common construction contracts, being:

  • General Conditions of Contract for Construction Works
(GCC – General Conditions of Contract)
  • Conditions of Contract for Works of Civil Engineering Construction: The Red Book
(FIDIC – International Federation of Consulting Engineers)
  • Principal Building Agreement
(JBCC – Joint Building Contracts Committee)
  • NEC3 Contract Suite
    (NEC – New Engineering Contract)

Family Law

I am a firm believer that an attorney in a divorce action should act as a buffer between the parties and remove the emotions from the action, enabling the parties to reach a cost effective settlement favorable to both parties.

In 2014 the Department of Justice and Constitutional Development introduced a court-annexed mediation program in the district and regional courts, currently implemented in Gauteng and North West. As part of the program, mediation in all divorce proceedings will soon be mandatory.

My early exposure to Alternative Dispute Resolutions, including Mediation and Arbitration, is a valuable tool in court-annexed mediation programs to the benefit of clients.

We attend to all aspects of family law, including:

  • Adoptions
  • Divorce Actions
  • Ante-Nuptial Agreements
  • Maintenance Applications
  • Family Violence Interdicts.
